Law 9.677/98, which amended Article 273 of the Penal Code, now provides the application of the same penalty (from 10 to 15 years of jail time) to very different severe situations in the context of the commerce of medicines and the like.

As a result, the Judiciary began to apply, by analogy, the penalty provided for the crime of drug trafficking to those caught with unregistered products, which is significantly lower than the penalty provided for by art. 273 of the Penal Code.
